Court Decision

The Colorado Court of Appeals threw out former Mesa County Clerk Tina Peters’ 9-year prison sentence.
The three-judge panel upheld her conviction on seven counts (four felonies and three misdemeanors), including official misconduct and tampering with election equipment.
The court ruled that the trial judge improperly considered Peters’ beliefs about 2020 election fraud when imposing the sentence, violating her First Amendment free speech rights.
Key quote from the 77-page opinion: “The trial court’s comments about Peters’s belief in the existence of 2020 election fraud went beyond relevant considerations for her sentencing.” Her offense was her “deceitful actions,” not her beliefs.
